The Malta Community Chest Fund Foundation – Online Art Auction

 

IMPORTANT

 

These terms and conditions apply to all online bidding at auction sales conducted by The Malta Community Chest Fund Foundation (MCCFF). By registering to participate in a MCCFF sale via artsauction.mt, you expressly agree to these terms and conditions.

 

Article 1 - Registration

(a) Before you can bid via Online Bidding, you must register on website having address artsauction.mt or any other address indicated from time to time by Online Bidding.

(b) In consideration of your use of the website, you agree to provide true, accurate, current and complete information about yourself as user of the website. If you provide any registration data that is untrue, inaccurate, not current or incomplete, The Malta Community Chest Fund Foundation has the right to suspend or terminate your account and refuse any and all current or future use of the website. Furthermore, The Malta Community Chest Fund Foundation shall not be held liable for any damages resulting from any data that is deemed to be untrue.

(c) Once you have registered you should keep your account details strictly confidential, and you must not permit any third party to use or access your account on your behalf or otherwise. You will be liable for all bids made via your account.

Article 2 - Liability

(a) The artsauction.mt is an online bidding website conducted by The Malta Community Chest Fund Foundation that allows users to offer, sell and buy artwork.

(b) The artsauction.mt website and the Malta Community Chest Fund Foundation does not accept any liability and does not provide any warranty for any condition report or item description. Images may not show the condition of the lot clearly. In particular, colours and shades may look different on screen to how they look in real life. For the avoidance of doubt, The Malta Community Chest Fund Foundation shall not be held liable for any difference that may appear between the artwork itself and its description or its image presented on artsauction.mt.

Article 3 - Online Bidding Process

(a) Once you have successfully registered for Online Bidding in an Auction, you will be eligible to bid online.

(b) During an Auction, you can bid for a lot by clicking the Bid button. Each bid shall be final and binding as soon as you click the Bid button.

(c) The current bid will be displayed on your screen during the Sale.

(d) You acknowledge that you are bidding in an online auction and you agree that each bid submitted as provided in these terms and conditions is irrevocable and cannot be amended or corrected, even if submitted in error and notified to us. You accept full liability for all bids submitted via your Online Bidding account including the liability to pay in full and on time.

(e) Please note that The Malta Community Chest Fund Foundation reserves the right to reject a registration to bid online, withdraw its permission for you to use Online Bidding, or terminate an Online Bidding account, for any reason at any time prior to, during or after a Sale.

Article 4 - After the Sale

(a) Successful bidding will be notified by email. This will include payment and collection instructions. Payment must be received by The Malta Community Chest Fund Foundation from the winning bidder not later than seventy-two (74) hours from the winning bidder being declared.

(b) You agree to pay for and collect any lot that is the subject of a successful bid submitted by you or from your Online Bidding account.

(c) Payments should be effected either via Bank Transfer to BOV Account with IBAN number MT06VALL22013000000040018344349 or by cheque made payable to The Malta Community Chest Fund Foundation sent by post to, MCCFF Accounts Department, San Anton Palace, Attard.

(d) Should a winning bidder not pay the relative price as per the conditions described in this article 4, The Malta Community Chest Fund Foundation reserves the right to cancel the bidding process with regards to said particular piece of artwork. In such cases, The Malta Community Chest Fund Foundation shall have the right to seek damages and/or a fine it may deem appropriate from said bidder.

Article 5- Use of the Online Bidding Service and Limitations of The Malta Community Chest Fund Foundation’s Liability

(a) When you choose to use the Online Bidding service, you do so entirely at your own risk. Access to and use of Online Bidding is dependent upon, among other things, the availability of the internet and the speed and quality of internet connections.

(b) We accept no liability for any failure or delay in executing bids or any errors contained in bids placed via the Online Bidding service.

(c) The Malta Community Chest Fund Foundation provides the online bidding service and the artsauction.mt website "AS IS" and without any warranty or condition. We accept no liability for failures, delays or errors caused by interruptions in the availability of the Online Bidding Service or our website or any errors or defects in their content or functionality, any software and/or hardware defects, whether yours or ours, and / or any internet connection problems; We do not guarantee that the online bidding service or the website will be free of error.

Article 6 - Changes to These Terms and Conditions

(a) We reserve the right, at our sole discretion, to change, modify, add, or remove any portion of these terms and conditions, in whole or in part, at any time. Any changes will be posted on our website and we will endeavour to notify you of the same by means of a notice and link to the revised terms on our website. Changes in the terms and conditions will be effective when posted. Please review these terms and conditions regularly to ensure you are aware of any changes made by us. If you use Online Bidding after changes have been made and posted, you shall be deemed to have agreed to such changes. If you do not agree to such changes, you should not make any subsequent use of the Online Bidding service.

Article 7 - Governing Law

(a) These Malta Community Chest Fund Foundation Online Bidding Terms and Conditions shall be governed by, and construed in accordance with, the laws of Malta and the Maltese Courts shall have the exclusive jurisdiction to adjudicate on any dispute that may arise with respect to any part of the auction or of these terms and conditions.

Article 8 - Data

(a) You are hereby providing your unequivocal consent to The Malta Community Chest Fund Foundation and/or by Online Bidding to hold any personal data that may be required limitedly for the processing of the bidding process, as well as for the processing of the eventual transaction for any successful bidder.

(b) Any and all personal data collected by The Malta Community Chest Fund Foundation and/or by Online Bidding is strictly for the processing of the bidding process, as well as for the processing of the eventual transaction for any successful bidder.

(c) You have the right at all times to contact info@artsauction.mt in order to be given a copy of your personal data being held and may also request that said personal data is deleted.

(d) The Malta Community Chest Fund Foundation and/or by Online Bidding hereby bind themselves to treat said personal data with utmost confidentiality and they hereby unequivocally declare that said personal data will not be used for any other purpose, being marketing or otherwise, other than for the purposes being described herein.
